If I am sued regarding this, will I lose the case?
I hired someone to fix the an air filtering unit in my house. They said they would put the invoice in the mail the next day. A week went by, and I hadn’t received anything. Over the course of five days, I left two voice mails for this person trying to find out the amount I owe him. He never returned my calls. Finally, I called a third time, and left a message saying that if I didn’t hear back from him in two days, I would assume he did the work for free. I never heard from him.
Now, some weeks later, I get a bill from him in the mail. But I already used the money I had set aside to pay him.
If he sues me, will he win?
